Terms and Conditions, Disclaimers, Waiver and Release of Liability

 

All Terms and Conditions, Disclaimers, Waiver and Release of Liability included on this page apply to each trip participant once a booking has been made. Acceptance and understanding of the Terms & Conditions and of the Waiver and Release of Liability must be indicated by the signing of said Terms & Conditions, Agreement/Disclaimer, Waiver and Release of Liability on the Trip Registration Form.

 

Deposits & Payments

 

For multiple day experiences Kabi requires a deposit of 50% with balance due 30 days prior to starting date of the experience. The deposit goes towards the price of the experience, and can be refunded depending on the booking conditions.

 

For bookings made less than 30 days prior to the starting date of the experience, full payments is required at the time of reservation.

 

Payments

 

Final payment is due 30 days prior to the start of the experience. One week before the balance is due, e-mail notification will be sent to inform of the final payment. If the balance has not been paid by the agreed upon date, customers will be contacted by email and/or telephone. If the balance remains unpaid, Kabi reserves the right to treat the reservation as cancelled and to retain the deposit.

 

Full payment for one-day experiences is due at the time of making the reservation.

 

Prices

 

Experience prices are quoted in Euros and are subject to change due to currency fluctuations or other factors beyond the control of Kabi. Changes in supplier charges occasionally make it necessary to change published experience prices. However, receipt of paid deposit(s) guarantees the published or quoted price at the time of booking.

 

Cancelation Policy

All cancelations must be made by email to Kabi as soon as possible.

  • Cancelations made one month prior to the start of an experience will be charged a cancellation fee of 10%.
  • Cancellations made one week prior to the event will receive a 50% refund
  • Cancellations made within 48 hours of the start of the experience will not be refunded.

 

Bookings can be rescheduled to a different date. However, this may involve an administration fee.

 

Changing the date of the experience will incur a 5% administration fee for itinerary changes within 48 hours of an event. Changes are subject to availability.

 

The purchase of travel insurance is strongly recommended as it may cover trip cancellation, trip interruption or trip delay for medical, work, weather or natural disaster-related reasons. 

 

Refunds

 

No refunds are issued in the event that the customer fails to participate in any part(s) of the experience. Most services are run by outside specialists and consultants meaning once a deposit has been received, any changes made by the travelers to the itinerary, after services are booked, may be subject to a cancellation fee or loss of payments made. There will be no refunds in the event that the entirety or any part of the experience is cancelled 48 hours or less before the experience begins, or in the event of a late arrival or early departure from the experience.

 

Please note that problems that may arise while on the experience should be addressed promptly with the guide, or by contacting Kabi while on the experience. Failure to address such problems while participating in the experience will mean that Kabi will be unable to offer any adjustment that otherwise might be available.

 

Tour Conditions

 

Prices given are per person and based on double occupancy when accommodation is included. A single supplement will apply for one person occupying a double room. If a participant would like to share a double room with another participant, Kabi will try to accommodate the request, but cannot guarantee its availability.

 

Please note that the hotels used by Kabi have been chosen for their unique character, charm, and comfort. Rooms in the double occupancy category vary in size, shape, and features. Kabi does their best to ensure that all rooms express the charm and historical nature of the buildings/regions visited. Kabi cannot guarantee that the rooms will be equal in size or features.

 

Experiences organized by Kabi require a minimum number of participants to operate. This number varies by tour. 

 

Kabi reserves the right to cancel any experience at any time before departure for any reason, including insufficient participants to operate the experience. In the unlikely event that an experience is canceled by Kabi each participant will be given a full refund or allowed to reschedule for an alternate experience date. Kabi is not responsible for any costs, including airfare or other personal expenses, incurred by travelers.

 

Kabi may occasionally find it necessary to modify the stated itinerary due to unforeseen circumstances, availability, or in order to improve the trip. In the event that an alteration to any part(s) of the itinerary is made, a substitution may be made of a service or good of equal or greater quality or value for any stated in any itinerary. Kabi expressly disclaims any liability for any damages resulting from any itinerary changes.

 

Hotels

 

During KABI experiences, customers stay in four and five-star hotels, as well as the occasional boutique hotel that may have a three-star rating, reflecting their lack of amenities such as conference rooms, restaurants and parking facilities but not their level of comfort. Many of the hotels are smaller, boutique hotels with a limited number of rooms. KABI cannot guarantee the hotels included in a trip proposal until the deposits have been received. The right is reserved to substitute similar or superior level hotels when necessary. Notification will always be given in the event of a particular hotel or hotels not being available.

 

Travel Documents

 

Each participant is responsible for obtaining and carrying a valid passport and for obtaining the appropriate visa(s) and any other required documentation for travel to the chosen destination.

 

Travel Insurance

 

The purchase of travel insurance is strongly recommended to protect our customers’ travel investments. Travel insurance offers coverage for unforeseen events such as trip cancellation, trip interruption, trip delay, medical expenses while traveling, emergency medical transportation, baggage loss, damage or delay, and more. The entire cost of a trip can be insured, including all pre-booked services and arrangements.

 

Health and Accessibility Issues

 

Please be aware that access to accommodations, transportation, restaurants, and other sites in Spain may differ from that in a customer’s own country. Disabled-access is not guaranteed. Many hotels are small, converted older buildings and may not have accessible entrances or facilities, including accessible restrooms or elevators. Streets may present difficult walking conditions due to uneven pavement, stairs and/or lack of sidewalks or walkways. Public sites and venues, including restaurants, food producers, wineries, and markets, that are visited may not be disabled-accessible and may lack wheelchair-accessible entrances, restrooms, and facilities or other accessibility for disabilities.

 

Kabi cannot guarantee the availability of special accommodations or disabled-access on any experience. As participation requires a minimum level of physical strengths, it is requested that each traveler discuss when booking, any medical or physical restrictions he or she may have; please make contact to discuss any condition that may affect travel.

 

Kabi reserves the right to not accept nor retain any participant whose health or actions in the sole judgment of Kabi may hinder or disrupt the itinerary. Medical coverage should be consulted to confirm a sufficient level of coverage while traveling away from home. Advice can be given as to the types of medical travel insurance available.

 

Payment of an experience certifies a customer’s sufficient good health, to the best of their knowledge, for participation in the preferred Kabi itinerary and confirms that any special medical or physical conditions or dietary demands that could affect participation in our itineraries have been fully disclosed to Kabi. Kabi would remind customers that health care facilities and services abroad may differ from those they are accustomed to, and may be insufficient for treatment of certain health conditions. Please be sure to pack all necessary medications when travelling abroad.

 

Dietary Restrictions and Allergies

 

Please inform us of any food allergies and/or dietary needs or restrictions. Kabi cannot guarantee that any dietary needs or restrictions can be accommodated given the nature of the itineraries, but all will be done to ensure a good experience for all customers. Any and all food allergies and dietary restrictions shall and must be disclosed to Kabi prior to trip commencement.

 

Disclaimers, Waiver and Release of Liability

 

The customer understands and agrees that Kabi does not own or operate any of the facilities or suppliers of accommodations and services for any given trip. Each individual tour participant agrees that Kabi and its representatives shall not be liable for any injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to any act of default of hotel, transportation carrier, restaurant supplier or other contractor providing services to Kabi and its participants.

 

Kabi and its representatives shall not be responsible for any expense or liability due to civil unrest, labor disputes, war or threat of war, acts of terrorism, government restrictions, weather, theft, fire or illness, or any other cause beyond their control.

 

Kabi and its representatives reserve the right to accept or refuse any person as a participant of a Kabi Experience.

 

Kabi and its representatives reserve the right to cancel any experience prior to departure for any reason, including insufficient number of participants, or to change itineraries and/or substitute services of equal or greater quality without prior notice.

 

The customer understands and agrees that Kabi provides active travel activities, and that these activities carry inherent risks. By participating in these activities arranged by Kabi or its employees, partners or agents, the customer agrees to the following:

1) Participation in active travel activities carries risks and may pose hazards and dangers.

2) The customer understands the risks and dangers associated with travel and all active travel activities, and assumes all responsibility for any losses and/or damages, caused in whole or in part by Kabi or its employees, agents, partners, or by any other person.

 

The customer understands that Kabi cannot guarantee disabled-access for hotels, restaurants, and venues visited during the experience.

 

The customer is responsible for adhering to the rules and laws of the localities while on the experience and traveling with Kabi or participating in activities arranged by Kabi or any of its agents or partners. The rights and privacy of fellow participants must be respected while on the experience. Kabi reserves the right to disqualify any participant before or during any itinerary if it is judged that their participation may compromise the safety or comfort of others.

 

By booking the itinerary, the customer affirms that they have understood and agreed to these Terms and Conditions, Waiver and Release of Liability.
